Welcome to Gilani’s Online (“Platform”), operated by Gilani’s Distributors Ltd (“GDL,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of the Gilani’s Online website and mobile application (together, the “Services”). By registering an account, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
You must be at least 18 years old and legally capable of entering into binding contracts under Kenyan law to use the Services.
By registering, you confirm that the information you provide is true, complete, and accurate.
Accounts are personal and non-transferable. You may not allow others to use your account.
To use the Services, you must first create a user account.
A ll accounts are subject to verification by our backend team. Only verified accounts will be allowed to place orders.
Upon successful verification, a corresponding customer account will be created for you in our Acumatica system.
Each user may only have one registered account with a single delivery address linked to it.
You are responsible for maintaining the confidentiality of your login details and for all activities under your account. GDL shall not be liable for any loss arising from unauthorized use of your account.
3.1 Orders may be placed through the Platform after account verification. A binding sales contract is formed only when GDL confirms acceptance of your order. .
All orders are subject to stock availability and confirmation by GDL. Prices and availability may change prior to confirmation.
You may pay for your orders in one of the following ways:
Pay-on-Delivery: Payment is made in full at the time of delivery using the methods communicated by our delivery team (e.g., cash, M-Pesa, card on delivery).
Pre-Payment via Payment Gateway: Payment can be made securely through the online payment options provided on the Platform at the time of placing your order.
Failure to make timely payment (whether via pre-payment or at the point of delivery) may result in cancellation of your order and suspension or termination of your account.
GDL reserves the right to cancel suspicious or fraudulent transactions.
Delivery is available only within designated service areas where GDL warehouses and distribution networks operate. Orders placed outside these areas will not be processed.
Orders placed outside the designated delivery areas will not be processed or delivered.
Estimated delivery times will be provided, but delays may occur due to factors outside our control. We are not liable for such delays in delivery.
Title and risk of loss or damage to goods pass to you upon successful delivery at your designated address.
Delivery fees may apply and will be disclosed at checkout before you confirm your order.
Orders placed through the Platform may be cancelled by the user only before it is confirmed by GDL. Any pre-payment will be refunded in accordance with our Refund Policy.
Once an order is confirmed by GDL, it cannot be cancelled by the user.
GDL reserves the right to cancel an order at any time due to product unavailability, inaccurate information, or other valid reasons. In such cases, any pre-payments made by the user will be refunded in accordance with our Refund Policy.
All product prices are displayed in Kenyan Shillings (KES) and are inclusive of applicable taxes, unless otherwise stated.
GDL reserves the right to change prices, discounts, and product availability without prior notice.
While we make every effort to ensure accuracy, errors in pricing, product descriptions, or availability may occur. In such cases, GDL reserves the right to correct errors and revise or cancel affected orders.
Product images are for illustration purposes only and may differ from actual products.
You agree not to:
Use the Platform for unlawful, abusive or fraudulent purposes.
Impersonate another person or misrepresent your identity.
Provide false or misleading information.
Use bots, scripts, or automation to place bulk or fraudulent orders.
Attempt to interfere with the operation or security of the Services.
You are responsible for maintaining the confidentiality of your login details and for all activities under your account.
All content on the Platform, including but not limited to text, images, graphics, logos, software, databases and trademarks, is the property of GDL or its licensors.
You may not copy, reproduce, distribute, modify, or exploit any content without prior written consent from GDL.
GDL reserves the right to suspend or terminate your account at any time if you:
breach these Terms;
Engage in fraudulent, abusive, or illegal activity.
provide false or misleading information; or
fail to pay for delivered goods.
You may close your account by contacting our support team, subject to settlement of any outstanding payments.
To the maximum extent permitted by Kenyan law, GDL shall not be liable for indirect, incidental, or consequential damages arising from your use of the Services.
GDL shall not be liable for delays or failures caused by events beyond its reasonable control, including but not limited to wars, government imposed lockdowns, strikes and demonstrations, floods, natural disasters, or internet outages (“force majeure”)
GDL’s total liability in connection with your use of the Services shall not exceed the total amount paid by you for the goods in question.
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, process and protect your personal information.
These Terms shall be governed by and construed in accordance with the laws of Kenya.
In the event of a dispute, parties shall first attempt to resolve the matter amicably through negotiation or mediation before resorting to court.
Any disputes not resolved amicably shall be subject to the exclusive jurisdiction of the courts of Kenya.
GDL reserves the right to modify these Terms at any time. Updates will be posted on the Platform, and continued use of the Services constitutes acceptance of the updated Terms.
